THIS LIMITED WARRANTY applies solely to standard programmable logic semiconductor devices manufactured by or on behalf of Xilinx (“Products”). Subject to the limitations herein, Xilinx warrants that Products will, for three (3) years following the date of sale by Xilinx or its authorized distributor, be free from defects in materials and workmanship and will substantially conform to Xilinx publicly available specifications and known errata in effect on the date of sale. This limited warranty excludes: (i) engineering samples and die (both of which are provided “AS-IS” without warranty); (ii) boards; (iii) Products procured from unauthorized sources; (iv) Products that have been subject to misuse, mishandling, accident, alteration, neglect, or unauthorized repair or installation; (v) Products used in an application or environment that is not within Xilinx specifications; and (vi) EasyPath™ products that are programmed with a design that differs from the design verified by Xilinx to program such products. For any breach by Xilinx of this limited warranty, the exclusive remedy of Buyer and the sole liability of Xilinx shall be, at the option of Xilinx, to replace or repair the affected Products, or to refund to Buyer the price of the affected Products. Buyer may not return Products without first obtaining a customer return material authorization (RMA) number from Xilinx. The availability of replacement products is subject to product discontinuance policies at Xilinx. Notwithstanding the term of this limited warranty, Products subject to PDN shall be covered for one (1) year from the date of last shipment to Buyer. THE WARRANTIES SET FORTH HEREIN ARE EXCLUSIVE. Subject to the limitations herein, Xilinx warrants that Development Systems will, for ninety (90) days following the date of sale by Xilinx or its authorized distributor, be free from defects in materials and workmanship and will substantially conform to Xilinx publicly available specifications and known errata in effect on the date of sale. This limited warranty excludes: (i) engineering samples or beta versions of Development Systems (which are provided "AS-IS" without warranty); (ii) Development Systems procured from unauthorized sources; (iii) Development Systems that have been subject to misuse, mishandling, accident, alteration, neglect, or unauthorized repair or installation; and (iv) Development Systems used in an application or environment that is not within Xilinx specifications. Furthermore, this limited warranty shall not apply to the use of covered products in an application or environment that is not within Xilinx specifications or in the event of any act, error, neglect or default of Customer. For any breach by Xilinx of this limited warranty, the exclusive remedy of Customer and the sole liability of Xilinx shall be, at the option of Xilinx, to replace or repair the affected products, or to refund to Customer the price of the affected products. CUSTOMER AGREES, PRIOR TO USING OR DISTRIBUTING ANY SYSTEMS THAT INCORPORATE XILINX PRODUCTS, TO THOROUGHLY TEST THE SAME FOR SAFETY PURPOSES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CUSTOMER ASSUMES THE SOLE RISK AND LIABILITY OF ANY USE OF XILINX PRODUCTS IN CRITICAL APPLICATIONS. (2008.05)

XILINX DOES NOT WARRANT THAT ES DEVICES ARE FULLY VERIFIED, TESTED, OR WILL OPERATE IN ACCORDANCE WITH DATA SHEET SPECIFICATIONS. XILINX DISCLAIMS ANY OBLIGATIONS FOR TECHNICAL SUPPORT AND BUG FIXES. XILINX SHALL NOT BE LIABLE FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, SPECIAL, RELIANCE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR IN CONNECTION WITH THE USE OF ES DEVICES IN ANY MANNER WHATSOEVER, EVEN IF XILINX HAS BEEN ADVISED OF THE POSSIBILITY THEREOF. XILINX MAKES NO REPRESENTATION THAT ES DEVICES PROVIDE ANY PARTICULAR FUNCTIONALITY, OR THAT ES DEVICES WILL MEET THE REQUIREMENTS OF A PARTICULAR USER APPLICATION.
